Orígenes del constitucionalismo americano.

El corpus ofrece cien documentos relacionados con el constitucionalismo norteamericano. El periodo considerado se inicia en 1606, con la proclamación de la Primera Carta de Virginia, que dio lugar al primer asentamiento permanente de Inglaterra en el continente americano, y se cierra en 1787 con el Decreto para el Gobierno de los Territorios del Noroeste, promulgado cuando ya estaba reunida la Convención de Philadelphia que dar¡a lugar a la Constitución federal de los Estados Unidos. Los documentos han sido seleccionados por su carácter constitucional: tratan sobre la organización del poder y los derechos. Se han ordenado de manera cronológica, método que permite al lector descubrir por s¡ mismo el progreso realizado Âûcon sus altibajosÂû en el constitucionalismo moderno durante esos 180 a?os. Los textos se han obtenido de más de setenta fuentes impresas disponibles, habiéndose consultado varios centenares de obras de los siglos XVIII y XIX principalmente. Con muy pocas excepciones, se han utilizado múltiples fuentes para la selección de cada texto, de las que se ha elegido como base la considerada más fidedigna y en notas se ha indicando las diferencias con otras fuentes, permitiendo as¡ al lector conocer las diversas variaciones textuales. La edición es bilingüe, as¡ el lector puede acudir al original y al mismo tiempo apoyarse en la traducción para resolver aquellos pasajes que, por su antigüedad o complejidad, le fueren más dificultosos. En la traducción se ha pretendido el delicado equilibrio entre mantener la literalidad del original y el estilo propio de su periodo y al mismo tiempo una justa corrección en el idioma castellano. Con cada documento se incluye una ficha en la que recoge la fecha, la fuente y unas brev¡simas notas históricas y editoriales. ______________________ __________ This work includes one hundred documents related to the American constitutionalism belonging to the period between 1606 and 1787. It starts with the First Charter of Virginia, which established the first permanent settlement at Jamestown, and ends with An Ordinance for the Government of the Territory of the United States, North-West of the River Ohio, piece of legislation issued when the Philadelphia Convention was already assembled and working on the U.S. Constitution. The criteria followed for the selection of the documents have been their legal character and that they establish some form of government or declare fundamental rights and liberties. The organization is strictly chronological, allowing in this way to ascertain the progress reached in constitutional law through those 180 years. The texts come from more that seventy printed sources (having researched several hundred works, mainly from the 18th and 19th centuries). With very few exceptions, for each text have been used several sources, selecting the one considered most reliable but commenting in footnotes the differences with other sources, thus providing the reader with an easy way to learn about the several variations of the texts. The documents are presented in a bilingual form because the objective is to be both a reference work and a means to reach the non-English speaking audience since the majority of these documents have not been available in the Spanish bibliography until now. In the translations (all of them original for this work) we have attempted to walk the narrow line between keeping the verbatim and original style of the texts and expressing it in a proper Castilian usage. Each document is preceded by a very brief reference note.
